4. Lawful bases for processing
UK data protection law requires me to have a lawful basis for processing your personal information.
Depending on the circumstances, I may rely on the following lawful bases:
Contract
I may process your information where it is necessary to enter into or perform a contract with you. For example, I need your information to provide your wedding photography services, deliver your photographs or fulfil a print order.
Legitimate interests
I may process information where it is necessary for my legitimate business interests, provided those interests do not override your rights and freedoms.
This can include responding to enquiries, managing my business, maintaining business records, improving my website and services, and protecting my business from fraud or misuse.
Legal obligation
I may process information where this is necessary for me to comply with a legal obligation, including tax, accounting and other regulatory requirements.
Consent
Where I rely on your consent to process information, I will ask for your consent where required and you can withdraw that consent at any time.
5. Photographs and images
As a wedding photographer, I create photographs containing identifiable people.
I process and retain photographs as necessary to provide the photography services you have booked, deliver your gallery and meet my contractual and legitimate business obligations.
I may also wish to use selected photographs for purposes such as:
My website portfolio
Social media
Blog posts
Advertising
Photography competitions or awards
Other promotional purposes
Where your photographs are to be used for promotional purposes, I will handle this in accordance with the terms agreed with you and any consent that is required.
My use of photographs for portfolio or promotional purposes may involve photographs of people who are not my direct clients, such as wedding guests. Where appropriate, I will consider the circumstances and any applicable privacy or consent requirements.
6. Where your information is stored
I use a combination of physical and cloud-based systems to store and manage business information and photographs.
Depending on the circumstances, information and photographs may be stored on:
Encrypted or password-protected SSD storage
My own NAS (network-attached storage) system
Google Drive
Dropbox
Pixieset
My website and associated website services
I take reasonable technical and organisational measures to protect information stored on these systems, including appropriate passwords, access controls and security measures.
Because I use third-party cloud services, your information may be processed or stored on servers located outside the UK. Where this occurs, the relevant provider is responsible for applying appropriate safeguards for international data transfers where required by applicable data protection law.
7. Pixieset
I use Pixieset to provide online galleries and deliver photographs to clients.
When I create a gallery for you, Pixieset may process information such as your name, email address and photographs in order to provide its gallery and delivery services.
Pixieset's own privacy policy explains how it handles personal information.
You can find further information in the Pixieset Privacy Policy.
8. Google services
I use Google Analytics to understand how visitors use my website and to help me improve its performance and content.
Google Analytics may collect information such as:
Website usage information
Device and browser information
Approximate geographical information
Pages visited
Interactions with the website
Where required, non-essential analytics cookies will only be used after the appropriate consent has been obtained.
I also use Google Search Console. Search Console provides information about how my website appears and performs in Google Search. It is primarily used to monitor website performance and search visibility rather than to identify individual visitors.
Google may process information in accordance with its own privacy policies and applicable data protection requirements.
9. Cookies
My website uses cookies and similar technologies.
Some cookies are necessary for the website to function. Other cookies, such as analytics cookies, may be used to understand how visitors use the website.
Where required by law, I will ask for your consent before placing or using non-essential cookies.
You can also control cookies through your browser settings.
The cookies and technologies used on my website may change as I add, remove or update website services.
10. Who I share your information with
I do not sell your personal information.
I may share personal information with third-party service providers where this is necessary to operate my business or provide services to you.
These providers may include:
Squarespace, which hosts my website and provides website and online shop functionality
Pixieset, which provides online photography galleries
Google, including Google Analytics and Google Drive
Dropbox, for cloud storage
Payment providers used by my online shop
Delivery and postal providers where required to fulfil print orders
Accounting or professional service providers where necessary
Government authorities or regulators where I am legally required to provide information
I aim to share only the information reasonably necessary for the relevant purpose.
11. How long I keep your information
I retain personal information only for as long as reasonably necessary for the purpose for which it was collected, or for as long as I am legally required to keep it.
Different information may be retained for different periods.
For example:
Enquiry information may be retained for a reasonable period after an enquiry so that I can manage follow-up communication and maintain appropriate business records.
Client and booking information may be retained for as long as necessary to provide my services and deal with contractual, legal, tax or accounting requirements.
Financial and order information may be retained for the period required by applicable tax and accounting requirements.
Photographs may be retained for as long as reasonably necessary to provide the services, maintain backups, deliver galleries and meet my contractual and legitimate business requirements.
Because photography files are backed up across multiple storage systems, deleting a particular photograph or piece of information from one system may not immediately remove every backup copy. Where information is no longer required, I will take reasonable steps to delete it from active systems and allow redundant backups to be overwritten or securely deleted in accordance with my normal backup processes.
12. Your rights
Under UK data protection law, you may have rights including:
The right to request access to the personal information I hold about you
The right to ask me to correct inaccurate information
The right to request deletion of your personal information in certain circumstances
The right to request restriction of processing in certain circumstances
The right to object to certain processing
The right to withdraw consent where processing is based on consent
The right to data portability in certain circumstances
These rights are subject to certain legal exceptions and limitations.
If you would like to exercise one of these rights, please contact me using the details below.
13. Keeping your information secure
I take reasonable steps to protect personal information against accidental loss, unauthorised access, alteration, disclosure or destruction.
These measures include appropriate passwords, access controls and security measures for my computers, storage devices, NAS and cloud services.
However, no method of electronic storage or transmission over the internet can be guaranteed to be completely secure.
14. Third-party websites
My website may contain links to third-party websites, including services such as Pixieset or social media platforms.
If you follow a link to another website, that website will have its own privacy policy and terms. I am not responsible for the privacy practices of third-party websites.
15. Your right to complain
If you have concerns about how I have handled your personal information, please contact me first so that I have an opportunity to address your concerns.
You also have the right to complain to the UK's data protection regulator:
Information Commissioner's Office (ICO)
Website: https://ico.org.uk/
The ICO provides information about your data protection rights and how to make a complaint.
16. Contact me
If you have any questions about this Privacy Policy or how I handle your personal information, please contact me.
17. Changes to this Privacy Policy
I may update this Privacy Policy from time to time to reflect changes to my business, the services I use or applicable data protection law.
The latest version will always be published on this website and the date at the top of the policy will indicate when it was last updated.
